JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bhagwanpur P.S. Case No. 191 of 2015 registered for the offences punishable under Section 376D of the Indian Penal Code and Sections 4, 6 & 8 of POCSO Act. Allegation against the petitioner is that he along with others committed sexual intercourse to the informant and the case is of the year 2015.

Submission of learned counsel for the petitioner is that as he was residing outside he has no knowledge about the same and in trial of co-accused in Juvenile Justice Board, the informant victim girl in her statement has not supported the case.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner.

Patna High Court CR. MISC. No.39960 of 2019(3) dt.17-08-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail. This application is, accordingly, dismissed.
