Petitioner is in custody since 13.07.2016 in connection with Janta Bazar P.S. Case No. 72 of 2016 registered under Sections 307, 326, 504 and 302 of the Indian Penal Code. Accusation is of murder by pouring K-oil on the body of the informant Sabana Khatoon and set fire, resultantly, the informant received burn injury.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case to land dispute. In fact, the informant herself poured K.Oil on her body. The petitioner, who is of clean antecedent, is languishing in judicial custody for the last five months.

Considering the nature of accusation, I am not inclined to

Patna High Court Cr.Misc. No.53451 of 2016 (3) dt.14-02-2017 grant regular bail to this petitioner. Accordingly, the prayer for bail of this petitioner is rejected.
