The petitioner seeks bail in connection with Sessions Trial No.269 of 2016, arising out of Kochadhaman P.S. Case No.24 of 2016, registered under Sections 395 and 397 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has come in the confessional statement of the co-accused Akbar alias Akbar Alam, as recorded on 03.03.2016. Except that, there is nothing against the petitioner to show his involvement in the present case. Further submission is that the co-accused Akbar alias
Patna High Court Cr.Misc. No.33560 of 2018(3) dt.02-08-2018 2/2 Akbar Alam and Nurshad alias Don alias Nurshad Alam have already been granted bail by a Bench of this Court vide order dated 17.05.2017 passed in Criminal Misc. No.21737 of 2017. The petitioner having no criminal antecedent is in custody since 20.08.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I, Kishanganj, in connection with Sessions Trial No.269 of 2016, arising out of Kochadhaman P.S. Case No.24 of 2016. Out of the two sureties, one must be either parents or the close relative of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
