JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-47 of the Bihar Excise (Amendment) Act, 2016. No doubt, earlier the petitioner was made accused in a case of Excise Act but in the present case, he was neither caught on the spot nor anything was recovered from his conscious possession and, it is alleged that he as well as other accused fled away from the place of occurrence, having thrown the seized country-made liquor.

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that the petitioner is languishing in jail custody

Patna High Court Cr.Misc. No.40448 of 2016 (2) dt.03-10-2016 2/2 since 16-07-2016, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Siwan Muffasil P.S. Case No. 177 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Siwan.
