This is a case registered under Section 7 of the E. C. Act. FIR has been lodged on the confidential information that from the PDS shop of one Niraj Navin @ Banti certain quantity of rice was being carried for black marketing using a vehicle, namely, BR 09 M-3372 and the petitioner was its driver.

Learned counsel for the petitioner submits that he is only the driver of the vehicle which was being used for transporting the rice of dealer Niraj Navin @ Banti which is also evident from his confessional statement itself. Said confessional statement forms part of the FIR also. He further submits that prior to this case, he has no antecedent and on his false implication he is in custody since 10.6.2017.
