The petitioner seeks bail in connection with Sessions Trial (S.Tr.) No. 753 of 2017 (arising out of Dulhin Bazar P.S. Case No. 140 of 2017), registered for the offence punishable under Sections 395/397 of the Indian Penal Code. Allegation against the petitioner is of robbery with attempt to cause death or grievous hurt.

It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case. It has been further submitted that the petitioner is not named in the FIR and his name has transpired in this case only on the basis of confessional statement of co-accused Ajit Kumar. Similarly situated co-accused persons have been granted bail by

Patna High Court Cr.Misc. No.33567 of 2018(3) dt.13-08-2018 2/2 co-ordinate benches of this Court vide orders dated 18.05.2018 in Criminal Miscellaneous No. 29978 of 2018 and dated 03.08.2018 in Criminal Miscellaneous No. 26184 of 2018. Petitioner is in custody since 29.01.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Danapur, Patna, in connection with Sessions Trial (S.Tr.)
