The petitioner seeks bail in Khudaganj P.S. case No. 9 of 2016 under Section 397 of the Indian Penal Code. The informant, owner of a truck, alleged that when he reached near Bagulwa turning a Bolero vehicle overtake the truck, three persons got down and assaulted the informant with fists and slaps and took away Rs. 50,000/- from both pockets of the informant and also looted away ATM card, PAN card, Adhar Card and cheques. The driver of the truck was also assaulted. Vijay Yadav, another owner of truck, was also assaulted and money was looted from his possession.
The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.47699 of 2016 (2) dt.22-12-2016 2/2 petitioner is not named in the FIR. The name of petitioner figured in the confessional statement of co-accused but similarly situated accused persons, namely, Suday Kumar, Mallu Yadav and Ramashray Kewat have already been granted bail. The petitioner was not put on T. I. parade.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in Khudaganj P.S. Case No. 09 of 2016.
