KUMAR ORAL ORDER 14-08-2018 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner, who is in custody, seeks bail in connection with Bhagwanpur (O.P. Tayay) P.S. Case No. 22 of 2018 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

Petitioner is the informant, who in her FIR has stated that on 18.02.2018 his husband had returned after attending Janau and marriage ceremony in her maternal grandfather place and thereafter she slept alongwith her husband and four children and in the morning of 19.02.2018 when she woke up at 5-6 AM she found that her husband is lying dead and his neck has been chopped. The FIR was lodged

Patna High Court Cr.Misc. No.33688 of 2018(3) dt.14-08-2018 2/2 against unknown. During investigation there was suspicion made against the petitioner that she is involved in murder of her husband. It has been further submitted that petitioner has been implicated in this case by her relatives in order to grab immovable property. Petitioner has been implicated in this case on basis of suspicion only. She has no criminal antecedent and is in custody since 15.03.2018.

Learned Counsel for the informant has vehemently opposed the prayer for grant of regular bail to the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Begusarai, in connection with Bhagwanpur (O.P. Tayay) P.S. Case No. 22 of 2018.
