2. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 323, 341, 379, 307, 325, 504, 506/34 of the Indian Penal Code pending in the learned court below.

3. Allegation against the petitioners is that they along with other co-accused persons and 55 unknown persons named in the FIR armed with various deadly weapons surrounded the house of the informant and assaulted the informant side and also snatched jewellery worth Rs. 2,50,000/.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this

He further submits that similarly situated other co-accused person has already been granted bail by a Cordinate Bench of this Court vide order dated 06.04.2023 passed in Cr. Misc. No. 75362 of 2022 (Annexure-02). He further submits that petitioners have got no criminal antecedent as stated in para-3 of the bail application.

5. Learned APP for the State opposes for prayer for bail.

6. Considering the fact that similarly situated co-accused has been granted anticipatory bail, let the petitioners, named above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of the learned Court below, where the case is pending/Successor court, in connection with Bihariganj P.S. Case No. 206 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
