The petitioners, who are in custody, seek bail in connection with Manjhi P.S. Case No. 57 of 2018 registered for the offence punishable under Sections 379, 420 of the Indian Penal Code and Section 27 (b) (ii)/28 Drugs an Cosmetic Act, 1940 and 8 (C), 22(C) of N.D.P.S. Act.
Allegation against the petitioners is that they were apprehended with two trucks loaded with cough syrup bottles of 100 ml each without having any valid receipt of challan or any other papers regarding consignment of the aforesaid article. It has been submitted on behalf of the petitioners that
Patna High Court Cr.Misc. No.38057 of 2018(3) dt.13-09-2018 2/2 the petitioners are driver of the aforesaid trucks and they have no knowledge about the articles loaded in the vehicle. It has been further submitted that they have no criminal antecedents and they are in custody since 15.03.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Saran at Chapra, in connection with Manjhi P.S. Case No. 57 of 2018.
