In the present writ petition the petitioner has claimed that in respect of the land in question, which was acquired the petitioner had filed a Title Suit. However, the compensation amount of the said land was being proposed to be given to the respondent no. 5.

The court is of the opinion that in view of the statutory provisions under the Land Acquisition Act, the petitioner is having remedy available to him. He can approach the authority concerned.

Accordingly, the writ petition stands disposed of with

Patna High Court CWJC No.9241 of 2011 (3) dt.01-07-2015 2/2 liberty to the petitioner to avail remedy as provided under the Act. It goes without saying that period consumed by the petitioner in pursuing the present matter i.e. from 19.5.2011 till date shall be excluded while considering the limitation matter.
