The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 448, 324, 307, 379/34 of the Indian Penal Code. It is alleged that the informant woke up hearing some sound and found that while committing theft the petitioners took out Rs.75,000/- from the box and on alarm being raised, petitioner Dhiraj Raj gave a knife blow causing injury on the nose of the informant.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.35888 of 2015 (2) dt.04-09-2015 2/2 petitioners that malicious accusation has been levelled against them. Injury report has been issued by a private doctor. Injury is alleged to have been caused by hard and blunt substance and incised injury has been found to be simple in nature. Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Mohania P.S. Case No. 243 of 2015 pending in the court of learned Chief Judicial Magistrate, Kaimur at Bhabua.

With the aforesaid observation, this application is disposed of.
