The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 452, 379, 504 and 506 of the Indian Penal Code.

It is alleged that accused persons came to the wheat field of the informant and started abusing the informant and on protest being made he was assaulted with axe on his head and in injured condition the informant came running to his house and the accused persons also came there chasing

Patna High Court Cr.Misc. No.35862 of 2015 (2) dt.04-09-2015 2/2 him and entered into his house. They assaulted the wife of the informant with Tangi on her head and snatched gold chain from her neck. On alarm being raised by the informant, his son came to rescue, accused persons also assaulted Raushan Mian with Tangi.

It is submitted by learned counsel for the petitioners that all the injuries are simple in nature caused by hard and blunt substance. There is counter version of the occurrence also. The petitioners have also received injury. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Kawakole P.S. Case No. 133 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
