JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-354(B) of the Indian Penal Code and Section-8 of the POSCO Act.

Allegation against petitioner is that he made attempt to remove the pant of informant's 8 years old daughter, for which, the petitioner is languishing in jail custody since 29-06-2016. Submission on behalf of petitioner is that the petitioner and the informant are agnates and as a matter of fact, the informant brought this false case due to enmity and previous dispute.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner

Patna High Court Cr.Misc. No.38713 of 2016 (2) dt.19-09-2016 2/2 named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sadar P.S. Case No. 226 of 2016 to the satisfaction of learned Additional Sessions Judge-Ist-cum-Special Judge, POSCO, Act, Vaishali at Hajipur.
