The petitioner apprehends his arrest in connection with Riga P.S. Case No.57 of 2016 registered under Sections 394 and 302 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that on the basis of the fardbeyan of the informant Shyambabu Prasad, the present case regarding the robbery and the murder of his brother Mohan Prasad was instituted on 17.03.2016 against three unknown. In course of investigation, the spy disclosed the name of the petitioner to the effect that the petitioner was seen moving on the
Patna High Court Cr.Misc. No.47658 of 2017 (2) dt.12-10-2017 2/2 road on the date of the alleged occurrence. Except that, nothing has been collected by the Investigating Officer against the petitioner in course of investigation.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No.57 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
