The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323 and 504/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The prosecution case is that the informant demanded due amount of the toddy being consumed by the accused persons when the accused persons abused and assaulted the informant with fists and slaps.
Patna High Court Cr.Misc. No.37612 of 2015 (2) dt.18-09-2015 2/2 It is submitted by the learned counsel for the petitioners that for the occurrence of 25.6.2014 the FIR was registered on 4.7.2014. The accusation is omnibus and general and the petitioners side lodged Neemchandpur P.S. Case no. 29 of 2014 against the informant at earlier point of time. Though other accused persons have been granted anticipatory bail, but this court is not inclined to grant anticipatory to the petitioners since they are accused in other cases apart from the present one. However, in the facts and circumstances of the case, in view of this court, it is a case for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with SC/ST P.S. Case No. 39 of 2014 pending in the court of learned ACJM, Begusarai.
This application is disposed of with the aforesaid observation/direction.
