The petitioner has renewed his prayer for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 102.24 litres of IMFL was recovered from the house of the petitioner while 2656.44 litres of IMFL was recovered from a truck parked outside the house of the petitioner.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 7.1.2022(Annexure-1) giving liberty to the petitioner to renew his prayer for bail after six months. It has been more than seven months since passing of the said order. The petitioner is in custody since 1.5.2021.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the liberty granted to the petitioner in the earlier order of rejection dated 7.1.2022 and the petitioner having remained in custody since 1.5.2021, the petitioner is directed to be enlarged on bail in connection with Manjhi P.S. Case no. 57 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge - cum - Special Judge, Excise, Saran. (Partha Sarthy, J) Spd/- U T
