JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section376 of the Indian Penal Code and 4 of the POSCO Act. This is a very serious case of committing rape upon a minor girl who subsequently, became pregnant. The victim has supported the occurrence in her statement recorded under Section164 of the Cr.P.C. The medical report also corroborates the allegation.
Therefore, considering the above-said facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Magadh University P.S.
Patna High Court Cr.Misc. No.44831 of 2016 (2) dt.20-10-2016 2/2 Case No. 35 of 2016 stands rejected.
