The petitioner has filed the instant application for grant of regular bail in connection with Srinagar (Pujaha) P.S. Case no. 45 of 2019 registered under sections 304 B, 201 and 34 of the Indian Penal Code.

As per allegation in the F.I.R., the accused persons including the petitioner herein are stated to have tortured the daughter of the informant for dowry. She was subsequently killed on 15.07.2019.

It is submitted by learned counsel for the petitioner that the petitioner is the brother of the husband of the deceased. The allegations are general and omnibus in nature. The fatherin-law of the deceased has been enlarged on bail vide order

Patna High Court CR. MISC. No.38221 of 2020(3) dt.09-03-2021 2/2 dated 04.11.2019 passed in Cr. Misc. No. 65294 of 2019. The husband of the deceased is in custody. The petitioner has no criminal antecedent and is in custody since 29.06.2020. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the relationship of the petitioner and his being in custody since 29.06.2020, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Srinagar (Pujaha) P.S. Case no. 45 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bettiah, West Champaran.
