2. The petitioner is in custody in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

3. As per allegation in the FIR, total 20 liters of country made liquor has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that nothing has been recovered from the conscious possession of the petitioner and the said liquor has been recovered from the bank of Sarju River, petitioner has got clean

Patna High Court CR. MISC. No.44302 of 2026(2) dt.08-07-2026 2/2 antecedent as stated in para-3 of the petition and he is in custody since 17.05.2026.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In view of the aforesaid submissions, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Excise Judge, Court Saran at Chapra in connection with Manjhi P.S. Case No. 258 of 2026.
