JUSTICE JYOTI SARAN ORAL ORDER 06-08-2015 Heard Mr. Arvind Kumar, learned counsel appearing on behalf of the petitioner and Mr. Nikhil Kumar Agrawal, learned Assisting Counsel to Government Pleader No.30 for the State.

The petitioner complains of encroachment on a public land the details of which are missing in the writ petition and even in the representation so relied upon. Having heard learned counsel for the parties and considering the nature of grievance the writ petition is disposed of with the liberty to the petitioner to file a duly constituted application before the Collector under the Bihar Public Land Encroachment Act, 1956 (hereinafter referred to as 'the Act') giving the details of the land, the extent of encroachment as well

Patna High Court CWJC No.11998 of 2015 (2) dt.06-08-2015 as the names of the alleged encroachers and it goes without saying that any such application filed by the petitioner would be considered and disposed of by the Collector under 'the Act' in accordance with law and after giving opportunity of hearing to the petitioner including the alleged encroachers.
