The petitioner who is in custody since 27.02.209 has filed the instant application for grant of bail in connection with Ara Nawada P.S. Case No. 446 of 2018 registered for the offence punishable under section 364 of the Indian Penal Code. As per the allegation in the FIR, the father of the informant who had gone to the market did not return. It is alleged that on talking on his mobile phone he appeared to be under some threat.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown accused persons. It is further submitted that the alleged vehicle by which the

Patna High Court CR. MISC. No.38021 of 2019(3) dt.11-09-2019 2/2 informant's father was kidnapped was recovered by the police for which one another case being Agrer P.S. Case No.21 of 2018 was registered wherein this petitioner was also made accused. In the said case this petitioner has been enlarged on bail vide order dated 07.02.2019 passed in Cr. Misc. No. 7123 of 2019.

The application for bail was opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case that the petitioner has been enlarged on bail in the case registered at the time of recovery of the victim as also the fact that the petitioner is in custody since 27.02.2019, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 446 of 2018.
