2. The petitioner is in custody since 16.03.2023 in connection with Pipra Kothi P.S. Case No. 63/2023 registered for the offence punishable under Sections 25(1-b),(II A), (1AA), 26 and 35 of the Arms Act.

3. As per the prosecution case, one country made pistol and one live cartridge has been recovered from the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the nothing has been recovered from the house of the petitioner. He next submits that the petitioner is not the owner of the seized motorcycle.

5. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.45860 of 2023(4) dt.17-10-2023 2/2 behalf of the State has vehemently opposed the prayer for bail. He submits that the petitioner is accused in 21 more serious cases.

6. Considering the facts and circumstances of the case and also the criminal antecedents of the petitioner, this application for grant of bail is dismissed.

7. The District Judge, East Champaran is directed to get the trial of all the cases registered against this petitioner expedited and conclude the same as early as possible as all the cases are registered in the district of East Champaran. (Sandeep Kumar, J) Saif/- U T
