JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-10-2018 The petitioner seeks regular bail in connection with Mashrakh P.S. Case No. 10 of 2018, registered for offences punishable under Sections 302, 201 and 120(B)/34 of Indian Penal Code.
Allegation as per F.I.R that a dead body was recovered, which was identified by the father of the deceased. It has been submitted on behalf of the petitioner that save and except suspicion, there is absolutely nothing against the petitioner. Further, he has no criminal antecedent and has been in judicial custody since 20.01.2018.

Patna High Court Cr.Misc. No.40057 of 2018 (5) dt.09-10-2018 for the informant opposed the prayer on the ground that the mobile phone of the deceased was recovered from the petitioner and at the instance of the petitioner aluminum wire, which was used to strangulate the deceased has been recovered and apart from that several paragraphs of the case diary supports the allegation. Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail.
This application for regular bail is, accordingly, rejected. However, the trial court is directed to expedite the trial. (Vinod Kumar Sinha, J) sunil/- U T
