Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is accused in connection with Ramgarhwa P.S. Case No. 187 of 2019, registered under Sections 376 and 506/34 of the Indian Penal Code. The acquisition is of committing rape on the informant by this petitioner thrice being her brother-in-law. Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected on merit
Patna High Court CR. MISC. No.11220 of 2021(2) dt.07-04-2021 2/2 vide order dated 04.03.2020 passed in Cr. Misc. No. 70877 of 2019 by this Court with observation that petitioner may renew his prayer for bail after completion of one year in jail custody and the petitioner is in custody since 08.09.2019 and now the petitioner has completed more than one year in jail custody. In view of the order dated 04.03.2020 passed in Criminal Misc. No. 70877 of 2019, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran, in connection with Ramgarhwa P.S. Case No. 187 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
