The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

A truck loaded with pulse was robbed leading to registration of the FIR against unknown. The name of the petitioner sprang up during investigation on the confession of co-accused Binod Giri, who suggested that the robbed articles were loaded on the truck of the petitioner.

It is submitted by learned counsel for the petitioner that even assuming the confessional statement of the co-accused it does not suggest the complicity of the petitioner and at best it reflects the complicity of the driver of the truck.

Patna High Court Cr.Misc. No.36732 of 2015 (2) dt.10-09-2015 2/2 A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Jagdishpur P.S. Case No. 103 of 2011 pending in the court of learned Chief Judicial Magistrate, Bhojpur at Ara.

With the aforesaid observation, this application is disposed of.
