Patna High Court Cr.Misc. No.37593 of 2015 (2) dt.17-09-2015 2/3 case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant after four years of marriage for non fulfillment of dowry demands of rupees two lacs. It is also alleged that the petitioners threatened the informant earlier for non-fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioners that the accusation of demand of dowry after four years of marriage appears unreasonable. It is further submitted that when the victim fell ill, she was taken to Primary Health Centre, Nasriganj and thereafter she was referred to Narayan Medical College, Sasaram. The postmortem report does not reflect any external injury hence the cause of death could not be ascertained by the doctor and the viscera was preserved. The petitioners claim to be separate from the husband of the victim. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class cum Addl.
