The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 323, 324, 354, 363, 448 and 307 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution story, in brief, is that the accused persons made attempt to forcibly take possession of Khata No. 62, Khesra Nos. 741 and 740, situated at village Pareuwa and also made firing when informant and several other persons made protest.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.06.2016. The charge sheet has been submitted in the present case. There is no allegation of

Patna High Court Cr.Misc. No.51192 of 2016 (2) dt.29-11-2016 2/2 tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. The other co-accused have been granted bail vide Annexure-3 series to the present application and Cr. Misc. No. 39657 of 2016 and Cr. Misc. No. 50876 of 2016.

On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari, East Champaran, in connection with Raxaul P.S. Case No. 88 of 2016.
