JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. In this case vide order dated 7.7.2017 case diary was called for.
The petitioner is in custody since 27.2.2017 in connection with Saharsa Sadar P.S. Case No. 173 of 2017 for the offence under sections 25(1-b)a, 26, 35 of the Arms Act. Counsel for the petitioner submits that the alleged recovery of arms is contrary to mandate of law because seizure list was prepared in breach of mandatory provision of the Cr.P.C. From perusal of the case diary, it appears that nothing specific is found in the case diary against this petitioner. In view of the fact that the petitioner is in custody since 27.2.2017 for the offence under the Arms Act, let the petitioner, named above, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.27622 of 2017 (3) dt.20-07-2017 2/2 bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 173 of 2017 on the condition that the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses.
