The petitioner apprehends arrest in a case registered for the offences punishable under sections 302/34 of the Indian Penal Code.
The informant, mother of the deceased, made allegation that when she returned to her house after marketing, she found her son hanging in the roof of the house. The informant suspected that one year ago the petitioner and his family members had kidnapped the daughter of the informant and they were threatening the informant to withdraw the case. It is submitted that the petitioner was in love with Kajal Kumari, daughter of the informant, who performed marriage in the temple. The victim made statement under section 164
Patna High Court Cr.Misc. No.39383 of 2015 (3) dt.30-11-2015 Cr.P.C. and disclosed the entire fact that the petitioner did not kidnap her rather she voluntarily left her house and now she is living with the petitioner. There is no direct or indirect evidence to show that the petitioner committed murder of son of the informant. Save and except suspicion, no material is collected by the police during investigation.
Considering the facts aforesaid, the petitioner above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Katihar Town (Sahayak) P.S. Case No. 146 of 2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973. (Prabhat Kumar Jha, J) Amin/- U
