JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-02-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Pupri P.S. Case No. 186 of 2020 for the offence under Sections 363 and 365 of the Indian Penal Code.

Learned counsel for the petitioner submits that the victim in her statement recorded under Sections 164 of the Cr.P.C. has already mentioned that at her own sweet will she left her house and went to her maternal house and after few days she returned to her home. He further submits that the victim has not alleged any kind of overt act against the petitioner. The petitioner has got no criminal antecedent and he is in custody since 05.08.2020.

Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds

Patna High Court CR. MISC. No.95 of 2021(2) dt.19-02-2021 2/2 of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Pupri P.S. Case No. 186 of 2020.
