4. There is no rejoinder thereto.

In this writ petition filed under Article 226 of the Constitution of India, the legality of the order dated 27.12.2013 (Annexure-6) passed by the respondent Sub-Divisional Officer has been challenged. By the said order, the Sub-Divisional Officer directed for unlocking the door of the room so that the same would handed over to applicant-respondent no. 9.

Patna High Court CWJC No.4695 of 2014 (4) dt.30-09-2016 2/2 Counsel for the State has pointed out with reference to the statement made in the counter affidavit that the petitioner has already filed a title suit in respect to the subject matter of the present case.

Counsel for the respondent no. 9 has also taken the similar stand.

In view of the aforesaid, this Court is not inclined to invoke its extraordinary and discretionary writ jurisdiction. The writ application is dismissed.
