JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-02-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Shyampur Bhataha P.S. Case No. 93 of 2019 for the offence under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b) a, 26 / 35 of the Arms Act.

Allegation against the petitioner is that he along with others were assembled for committing crime and during search one 9 MM Pistol and other weapons were recovered. Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner. The petitioner is in custody since 01.06.2020.

Considering the period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two
