JUSTICE BIRENDRA KUMAR ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is languishing in custody for the offences punishable under Section 366A of the Indian Penal Code. Petitioner is suspected to have kidnapped Nusarat Khatoon, the minor daughter of the informant. As per F.I.R. the victim girl as well as the informant has already been examined in Trial No.28 of 2016 as PW 3 and PW 4. PW 3 Nujrat Khatoon had deposed that she had requested the petitioner to carry the victim to her house on motorcycle. The petitioner took her to the house of the sister of the victim girl where she remained for 10-12 days thereafter police came and arrested her. He further stated that due to some misconception, mother of the victim lodged the case against the petitioner. Almost same is the statement of informant,

Patna High Court Cr.Misc. No.46320 of 2016 (3) dt.13-12-2016 2/2 who was examined as PW 4.

Considering the aforesaid statement of the material witnesses, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Sitamarhi/Successor Court, in connection with S.T. No.142 of 2016, arising out of Bela P.S. Case No.152 of 2015.
