The petitioner is languishing in custody for the offences punishable under Sections 366A/376(c)/506/34 of the Indian Penal Code and Section 4 of POCSO Act in connection with Nawada Mahila P.S. Case No.20 of 2020.

Allegation against the petitioner is that he ravished to a minor girl. The victim has supported the aforesaid allegation in her statement under Section 164 Cr.P.C.

Learned counsel for the petitioner submits that there is delay in lodging the FIR. The medical report does not corroborate the statement of the victim.

No prejudice has been caused due to few days delay in lodging of the FIR.

Patna High Court CR. MISC. No.38313 of 2020(3) dt.26-02-2021 2/2 Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The trial Court is directed to expedite the trial.
