The petitioner seeks bail in connection with Vijaipur P.S. Case No. 232 of 2017, registered under Sections 363, 366 and 302 of the Indian Penal Code.

The accusation is that on 09.12.2017, the daughter of the informant after taking dinner slept in the house, but on the next morning, she was not found in the house and her mobile was also found switched off. Learned counsel for the petitioner submits that on the basis of the fardbeyan of Guddi Devi, Bijaipur P.S. Case No. 232 of 2017, under Section 363, 366 (A) was instituted on 10.12.2017. Later on, on 17.12.2017 the dead body of daughter of informant was recovered from the bush of village

No.34105 of 2018(3) dt.02-08-2018 2/2 Khanua, after three days of the recovery of dead body, the informant gave her restatement before the Police raising suspicion against the petitioner having hand in the murder of her daughter as this petitioner, who is co-villager, was absent during that period at his house. Except that nothing has been collected by the I.O during the course of investigation showing his involvement. The petitioner has no criminal antecedent and he is custody since 17.01.2018 and after investigation, the Police also submitted Chargesheet in this case. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Vijaipur P.S.
