JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant lodged the present case against unknown persons but when further statement of informant was recorded, she disclosed that petitioner had given a proposal of marriage to the victim and, furthermore in course of investigation, it came to light that petitioner used to talk with the deceased and prior to the alleged occurrence, he had made conversation on phone with the victim. It appears that except the aforesaid material, there is nothing against the petitioner, who is languishing in jail custody since 26.02.2016 and the investigation against him has already been completed.

Accordingly, let the petitioner, above named, be
