The petitioner has preferred this application for grant of regular bail in a case registered under sections 413 and 414 of the Indian Penal Code.

As per the prosecution case, the two accused persons including the petitioner herein were arrested and stolen motorcycle was recovered from their possession. It is submitted by learned counsel for the petitioner that no incriminating article nor any motorcycle has been recovered from his possession. He has been falsely implicated in the case because of his antecedent. He is in custody since 5.1.2021 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

No.53216 of 2021(2) dt.11-03-2022 2/2 Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Baniyapur P.S. Case no.7 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra.
