This is an application for bail in connection with Hilsa P.S. Case No. 508 of 2017 registered for the offences punishable under Sections 353, 307, 186, 115/34 of the Indian Penal Code and 3 of Damage of Public Property Act.
Petitioner is named in the FIR and there is allegation that when police tried to intercept the truck loaded with sand the truck driver did not stop his vehicle and dashed the police and thereafter petitioner has been arrested.
Submission of learned counsel for the petitioner is that petitioner is Khalasi of the truck and he is not driver and he is in custody for about two months.

Having heard both sides and in view of facts and
Patna High Court Cr.Misc. No.46448 of 2017 (2) dt.20-09-2017 2/2 circumstances, this application is disposed of with a direction to the court below that once charge sheet has been submitted against the petitioner and except whatever has been stated in FIR if there is no other allegation, the court below will release the petitioner on bail to its satisfaction, if an application for bail is filed on behalf of petitioner.
