23-02-2016 Heard learned counsel for the petitioner and Sri Ratan Prasad Sinha, learned counsel for the respondent/Bihar State Power Holding Corporation.

The petitioner in the present writ petition has made a prayer to direct the respondents i.e. respondent no. 1 to 3 to disconnect the electric supply, which has been provided to respondent no. 4.

It has been claimed that in the premises of the petitioner, without his consent, electric supply was provided to respondent no. 4. The petitioner has repeatedly filed application

Patna High Court CWJC No.12610 of 2014 (2) dt.23-02-2016 2/2 for disconnecting the same, however; till date, no decision has been taken.

In view of nature of relief sought for in the present writ petition, the Court proposes to dispose of the writ petition granting liberty to the petitioner to file a fresh application before the respondent no. 2 i.e. Executive Engineer, Bihar State Power Holding Corporation, Bandar Bagicha, Patna alongwith supportive documents. If such application is filed within a period of six weeks from today, the respondent no. 2 may examine the same and pass appropriate order in accordance with law. Even in case of refusal to the prayer of the petitioner, the respondent no. 2 is required to pass a speaking order and communicate the same to the petitioner within a period of eight weeks from the date of filing of such application.

The writ petition stands disposed of.
