This is a petition for grant of regular bail for offence under Sections 302 of the Indian Penal Code and 27 of the Arms Act.

The prosecution story, in brief, is that the informant's brother got injury in an attack and admitted in the Subdivisional Hospital, Danapur, where the doctor declared him dead. There is suspicion that his brother has been killed due to business rivalry. It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.02.2016 and the charge sheet has been submitted in the present case. There is no criminal antecedent. There is no allegation of tampering of the witnesses against the petitioner. The petitioner is not named in the first information report. His name has come on the confessional statement of the co-accused and except that there is no direct or indirect evidence against the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Danapur P.S. Case No. 706 of 2015 to the satisfaction of the Additional Chief Judicial Magistrate, Danapur.
