====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-08-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Pirpainti P.S. Case No. 46 of 2022, registered for the offences punishable under Sections 147, 149, 341, 323, 504, 506, 307 and 302 of the Indian Penal Code.

3. It is alleged that this petitioner along with FIR named accused persons caused death of father of the informant by inflicting grievous injuries.

4. It is submitted on behalf of the petitioner that the petitioner has been falsely implicated in the present case due to money dispute. It is further submitted that FIR was lodged after an inordinate delay of four days and there is no valid explanation for the same. Specific allegation of assault is against

Patna High Court CR. MISC. No.44554 of 2024(2) dt.30-08-2024 2/2 the co-accused, namely, Santosh Mandal who is alleged to have assaulted on the head of deceased. Doctor has also found only one injury on head during course of post mortem. Petitioner is in custody since 22.8.2023.

5. Learned APP vehemently opposes the prayer of bail of the petitioner.

6. In the facts of the case, let the petitioner as named above be released on bail on furnishing baili bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge XI, Bhagalpur, I/C Sessions Trial No. 52/2024, Pirpainti Police Station Case No. 46 of 2023.
