JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Spl. Case No. 08 of 2017 arising out of Dighalbank P.S. Case No. 10 of 2017 for the offence under section 354B of the Indian Penal Code and Section 8, 12 and 18 of the Posco Act. The allegation against the petitioner is that with bad intention, he caught hold the victim girl and tried to drag her in the maize crop field. There is statement on affidavit in para-3 that the petitioner has no criminal antecedent.
The petitioner is in custody since 9.2.2017.
In view of the statement made in para-3 on affidavit and considering that the petitioner is in custody since 9.2.2017, let the petitioner, named above, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.28205 of 2017 (3) dt.20-07-2017 2/2 bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Kishanganj, in connection with Spl. Case No. 08 of 2017, arising out of Dighalbank P.S. Case No. 10 of 2017 on the condition that one of the bailors should be close relatives of the petitioner and further the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses.
