====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 05-09-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Baniyapur P.S. Case No. 9 of 2018 registered for the offences punishable under Sections 304B, 201, 384 and 34 of the Indian Penal Code.

Informant who is the mother of deceased has stated in her fardbeyan that marriage of her daughter was solemnized with Ranjeet Sah on 07.07.2014 and sufficient gift, cash, ornaments and other things were given in the marriage. It has been alleged that her daughter was tortured due to nonfulfillment of demand of dowry and on 07.04.2015 she got an information that her daughter has died. It has been alleged that accused persons killed her daughter due to non-fulfillment of

Patna High Court Cr.Misc. No.37602 of 2018(3) dt.05-09-2018 2/2 demand of dowry.

It has been submitted on behalf of the petitioner that he is innocent and committed no offence and has been falsely implicated in this case. Petitioner is the father-in-law of the alleged victim and lives separately and had no concern with the affairs of the husband and wife. He is in custody since 21.05.2018. It has been further submitted that similarly placed co-accused has been granted anticipatory bail by co-ordinate Bench of this Court in Cr. Misc. No. 41028 of 2018 vide order dated 17.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- 11, Saran in connection with Baniyapur P.S. Case No. 9 of 2018.
