Petitioner, Tanmay Kumar Pandey, is in custody since 31.07.2016 in Rail Bhagalpur P.S. Case No. 78 of 2016 registered under Section 47A/53B of the Excise Act.

The allegation is that from the possession of the petitioner three bottles of foreign liquor each containing 750 M.L. were recovered 4. Learned counsel for the petitioner submitted that the petitioner is a young boy and is in custody from more than 1.5 months. 4.

Considering the quantity recovered from the possession of the petitioner, I direct the petitioner, above named, be released on bail on furnishing bail bond of Rs. 5,000/- (Five Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Bhagalpur in connection with Rail Bhagalpur P.S. Case No. 78 of 2016.
