The petitioner seeks bail in connection with Sursand (Bhitha More O.P.) P. S. Case No.56 of 2021, instituted for the offences under Sections 457, 380 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 08.06.2021, charge-sheet has been submitted in the case and has antecedent of five cases. The learned counsel for the petitioner submits that the informant alleges that when he came out of his house at 7.00 A.M. on 04.02.2021, he saw the lock of the house of his cousin brother was broken and theft of articles, as detailed in the F.I.R., was committed.

The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.55784 of 2021(2) dt.22-02-2022 2/2 F.I.R. was against unknown and the petitioner has been falsely implicated merely because of his antecedents. Nothing was recovered from his possession and he was made to confess his crime while in custody.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and nothing was recovered from his possession and was made to confess his crime while in police custody, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Sri Kabindra Kumar, learned Judicial Magistrate, 1st Class, Pupri at Sitamarhi in connection with Sursand (Bhitha More O.P.) P. S. Case No.56 of 2021, subject to condition that one of the bailers shall be the wife of the petitioner namely, Babita Devi. The application stands allowed.
