JUSTICE MADHURESH PRASAD ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offence under sections 3399 and 402 of the IPC and under sections 25(1b)a, 26 & 35 of the Arms Act.
Police, on chase, apprehended the petitioner and two others, while three persons succeeded to flee away. On search, one country made pistol, four cartridges, one Samsung mobile phone and Rs.1250/- were recovered from the possession of the petitioner.
Learned counsel for the petitioner submits that he is in custody since 21.3.2017 and out of five pending cases, mentioned in paragraph 3 of the bail petition, he is on bail in three cases, whereas compromise has taken places in one of the remaining cases and bail petition in respect of last case, i.e., Kasim Bazar Police station Case No. 67 of 2017 is still pending

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in Kasim Bazar Police station Case No. 68 of 2017, GR No. 640 of 2017.
