The petitioner seeks bail in Bachhwara P.S. Case No. 95/2018, instituted for offence under Section(s) 147, 148, 149, 120(B) and 302 of the Indian Penal Code read with Section 27 of Arms Act.

In the written report, there is specific allegation against this petitioner of causing firearm injury to the husband of informant, who died on the spot.

Post-mortem report is available in case diary, wherein doctor has found one firearm injury over right side of back, which is caused by petitioner.

Learned Addl. P.P. has submitted that petitioner is main assailant in this case.

No.39632 of 2019(3) dt.28-08-2019 2/2 Considering the fact that there is direct allegation against this petitioner of causing firearm injury to the husband of informant, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of petitioner is rejected. The trial court is directed to expedite the trial and make efforts to conclude the same within a period of nine months from the date of receipt/production of copy of this order. Petitioner may renew prayer for bail in the event trial is not concluded within aforesaid period.
