This application is for grant of regular bail in connection with Hajipur Town P.S.Case No.33 of 2017, registered for the offences under Sections 414/34 of the Indian Penal Code & 25 (1b)a, 26 and 35 of the Arms aAct and 8,20 (b)(ii)(B) of the NDPS Act.
Allegation as per F.I.R. is that the police intercepted the vehicle and arrested five persons including the petitioner and seized one country-made pistol and cartridges. It is further submitted that 2.10 kg. 'ganja' and one master key of vehicle have also been recovered from the vehicle.
It is submitted on behalf of the petitioner that he has been falsely implicated in this case. He has no criminal antecedent. The
Patna High Court Cr.Misc. No.24678 of 2017 (3) dt.05-07-2017 2/2 petitioner is in custody since 19.1.2017.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months. At the same time, the S.P., Vaishali at Hajipur is also directed to ensure present of the witnesses in this case so that trial may be concluded within the period as specified. With the aforesaid observation, this application is dismissed.
