The petitioner seeks bail in anticipation of his arrest in connection with Chapra Muffasil P.S. Case No. 416 of 2020, instituted for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016. According to the First Information Report, 25 litres of liquor is said to have been recovered from a room where animal fodder was kept. The petitioner denies that the place of recovery belongs to him.
The petitioner does not have criminal antecedents.

No.40636 of 2020(2) dt.16-06-2021 2/3 Considering the aforesaid submissions on behalf of the petitioner, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the Court below within a period of eight weeks from the date of receipt/ production of a copy of this order, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Special Judge, Excise, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 416 of 2020, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
However, before granting bail, the court below shall have it confirmed from the Investigating Officer or perhaps from the Panchayat functionaries about the ownership of the aforesaid place from where recovery has been made and then only shall release the petitioner on bail.
In case the information is not found to be correct,
Patna High Court CR. MISC. No.40636 of 2020(2) dt.16-06-2021 3/3 this order shall not be given effect to.
The application stands disposed of with aforesaid observation.
